These terms and conditions (the “Terms and Conditions”) govern the use of www.vndecor.ca (the “Site”). This Site is owned and operated by Lottie Guhle. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of Lottie Guhle and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;
  • Violate the rights of other users of our Site;
  • Violate the intellectual property rights of the Site owners or any third party to the Site;
  • Hack into the account of another user of the Site;
  • Act in any way that could be considered fraudulent; or
  • Post any material that may be deemed inappropriate or offensive.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

User Contributions
Users may post the following information on our Site:

  • Public comments.

By posting publicly on our Site, you agree not to act illegally or violate these Terms and Conditions.

Accounts
When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
  1. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods are available on our Site:

  • Refinished furniture;
  • Digital designs;
  • Custom décor;
  • Print-on-demand items;
  • Refinishing services; and
  • Other unique items.

The following services are available on our Site:

  • Refinishing furniture.

The services will be paid for in full down payment.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Payments
We accept the following payment methods on our Site:

  • Credit Card;
  • PayPal;
  • G Pay;
  • Apple Pay;
  • Third Party website: Etsy purchases;
  • Cash in person; and
  • e-transfer in person.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

  • Canada Post Regular or Xpresspost. Delivery costs and times vary depending on final destination.
  • Pick up in person.
  • Prepaid shipping via courier.
  • Delivery in person.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

Canada Post

Canada Post shipments will take place as soon as reasonably possible. Depending on the delivery method selected, delivery times may vary. Shipping times (the time to get the item to Canada Post) may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

If you purchase goods from us for delivery to a destination outside Canada, your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You must provide us with a complete and accurate delivery address, including the recipient’s name. We are not liable for the delivery of your goods to the wrong address or person due to you providing us with inaccurate or incomplete information.

In-Person Pickup

Customers should be able to transport large items or arrange for delivery if they are unable to pick up the item. Customers must be able to transport the furniture in their vehicle and under their power. Customers should bring suitable items such as moving blankets, cardboard, or other methods to protect the product from damage.

Vintage Nouveau is not responsible for damage incurred during or after transport. All sales are final.

In-Person Delivery

Delivery in person by the business is at the discretion of the business and subject to their terms, such as curb-side delivery, no in-home delivery. Delivery is limited to a pre-defined area in and around Sherwood Park. Additional fees will apply.

Third-Party Transport

Third-party transport may be arranged, if applicable. Contact the business to discuss this prior to purchasing.

All transportation is at the risk and under the responsibility of the customer. No liability or warranty is implied or assumed. All sales are final.

Print-on-demand

Print-on-demand items are shipped by a third party and not the responsibility of Vintage Nouveau. Please see the terms and conditions on Etsy, the website where these purchases are made.

Refunds
Refunds for Goods
Refund requests must be made within 15 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

  • Good is broken; or
  • Good is damaged.

Refunds do not apply to the following goods:

  • Custom furniture;
  • Print-on-demand products; and
  • Digital downloads.

Returns
Returns can be made by mail. To return a good by mail, follow the following procedure:
Pack the goods securely and return them via Canada Post or courier services available to the customer. A return address will be provided once the return is approved.

 

Refinishing Services
The following applies to custom refinishing services sold on our Site:

Quotes

  • Quotes are provided as a service to the customer to give them a detailed description of the work that will be performed.
  • Should the customer wish to make changes to the scope of the work, these changes can be made until the quote has been signed.
  • Once signed, the quote becomes a contract and is considered legally binding.

Changes

  • If changes are required, a change order will outline changes made by the customer or the business.
  • If the customer agrees, they will sign the change order and pay any additional deposits required to meet the 50% deposit requirement.

Contracts

  • Each quote, once signed and becomes a contract, includes terms and conditions of the refinishing service and will outline the products or colours used.
  • If the customer agrees to the terms and conditions and services outlined in the quote, they will sign it.
  • The signed quote becomes a contract.
  • The contract date and the paid deposit(s) will determine the start date of the work. The latter of the two dates will be the accepted date.
  • The estimated date of completion is a guideline. Due to circumstances outside the control of the business that may arise, this cannot be a guaranteed date.

Deposits

  • Security deposits may be required to hold a spot for future refinishing services if there isn’t an opening when the contract is signed.
  • Down payments of 50% of the final contract price are required before work begins.
  • Exceptional circumstances may require a higher down payment. For example, if the customer requires an expensive treatment or product.
  • Security deposits and down payments are non-refundable.
  • The down payment will be made before or upon dropping off the furniture for refinishing.

Cancellation

  • If a contract has not been signed, then no obligation is assumed on either party’s part once the expiry of the quote’s validity period, which is shown on the quote.
  • Cancellation of signed contracts must be in writing.
  • Verbal cancellation of contracts, in person or by phone, will be acceptable if no work has occurred.
  • Cancelled contracts forfeit all deposits paid.
  • Should a customer wish to cancel the contract, all work will stop on the piece once the business receives and acknowledges written cancellation.
  • Should the customer cancel a contract once work has started, and should the work not exceed the 50% deposit amount, the customer will not have to pay the total contract price before the customer picks up the piece.
  • Should the customer cancel a contract once work has started, and should the work exceed the 50% deposit amount, the customer will pay the total contract price before the customer picks up the piece.
  • The business will determine the 50% completion amount. Since this is a subjective timeline, the customer should discuss with the business the current progress on the piece to determine its level of completion.

Services

  • Custom refinishing services are non-refundable.
  • All services are considered final and will be performed per the contract the customer signed.

Payment

  • Payment in full is required to pick up the finished pieces.
  • No piece shall leave the property without confirmation of final payment.
  • All paid deposits are applied against the final contract price.
  • Future quotes and communications will open a new contract.

Guarantees
The following guarantees apply to our Site:

  • While every effort is made to provide a quality product, product sales are final, as is.; and
  • If your product does not meet your expectations, please reach out to Vintage Nouveau to discuss your options.

Consumer Protection Law
Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Links to Other Websites
Our Site contains links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to on our Site. You are responsible for reading the terms and conditions and privacy policies of these third party websites before using them.

Limitation of Liability
Lottie Guhle and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses, including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site, you indemnify and hold harmless Lottie Guhle and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses, including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
The laws of the Province of Alberta govern these Terms and Conditions.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. The removal will not affect all other provisions, and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
